Upon termination, your right to use the Platform shall immediately cease. 3. Permitted Use of the Platform 3.1. Platform Functionality: DnDUnited.com serves as an interactive community platform intended to facilitate connections among individuals with an interest in Dungeons & Dragons. This includes enabling Players to discover and engage in virtual or in-person game sessions hosted by Dungeon Masters (DMs), allowing Crafters to offer and sell handcrafted D&D-related goods, and providing various community interaction features. 3.2. Standards of User Conduct: Your use of the Platform must at all times be ethical, lawful, and respectful of other Users. You are strictly prohibited from engaging in any conduct that is unlawful, harassing, defamatory, abusive, threatening, obscene, invasive of privacy, infringing of intellectual property rights, or otherwise objectionable. DMs bear the explicit responsibility to provide clear and conspicuous content warnings within their game descriptions for any potentially sensitive or triggering material, encompassing, by way of example and without limitation, epilepsy warnings, triggers for phobias (such as arachnophobia), and depictions of mature themes including, but not limited to, nudity, explicit language, depictions of violence, sexual assault, and other potentially disturbing content. 3.3. Responsibilities of Dungeon Masters (DMs): DMs are exclusively responsible for the creation, content, execution, and management of their offered game sessions. DMs warrant that all descriptions of their games, including pricing, scheduling, game system, and all content warnings, are accurate and not misleading. Players may submit post-session reviews of the game and the DM. DnDUnited reserves the absolute right to take action, including but not limited to limiting access, suspending, or permanently banning DMs who receive a disproportionate number of negative reviews or who otherwise violate these Terms. The pricing of game sessions is determined solely by the DM and is not subject to negotiation on the Platform. DMs are further responsible for adhering to all guidelines and policies established by DnDUnited. DMs acknowledge and agree that they are solely responsible for ensuring their compliance with all applicable local, national, and international laws and regulations pertaining to the provision of their game services, including, without limitation, tax obligations and the lawful use of any intellectual property. 3.4. Responsibilities of Crafters: Crafters are exclusively responsible for the quality, accuracy of descriptions, and fulfillment of their listed products. Crafters warrant that all product descriptions, including pricing and shipping details, are accurate and not misleading. Shipping costs are to be determined and managed solely by the Crafter. The Crafter bears all responsibility for managing returns and refunds in accordance with their own stated policies. Buyers may submit post-purchase reviews of the crafts and the Crafter. DnDUnited reserves the absolute right to take action, including but not limited to limiting access, suspending, or permanently banning Crafters who receive a disproportionate number of negative reviews or who otherwise violate these Terms. The pricing of crafts is determined solely by the Crafter. Crafters acknowledge and agree that they are solely responsible for ensuring their compliance with all applicable local, national, and international laws and regulations pertaining to the offering and sale of their crafts, including, without limitation, tax obligations and the lawful use of any intellectual property. DnDUnited provides a platform for the marketing of crafts and integrates with Stripe for payment facilitation but explicitly disclaims any responsibility for the quality, delivery, returns, or any other aspect of the transaction beyond providing the Platform. 3.5. Prohibition of Unauthorized Session Recording: The recording of any game sessions organized through the Platform by any User, including DMs and Players, is strictly prohibited without the express, prior written authorization of DnDUnited. Any User who engages in unauthorized recording shall be solely liable for all consequences thereof, and DnDUnited and all affected Users reserve all rights and remedies available under applicable law, including, without limitation, the right to initiate legal action for injunctive relief and monetary damages, the quantum of which shall be determined at the sole discretion of DnDUnited. 3.6. Community Feature Guidelines: Any community features provided on the Platform, such as chat forums and user groups, are intended for respectful and constructive interaction among Users. You agree to abide by any community guidelines established by DnDUnited, including prohibitions against soliciting or discussing off-Platform payments or promoting external communities or platforms not officially endorsed by DnDUnited. DnDUnited reserves the right to implement and modify lists of prohibited words and to moderate user interactions within these features. 4. Financial Transactions 4.1. Pricing Autonomy: DMs and Crafters shall independently determine the pricing for their respective game sessions and crafts. All listed prices are final and not subject to negotiation through the Platform. Shipping costs for crafts are established by the Crafter and will be disclosed to the buyer prior to purchase. 4.2. Payment Processing Mechanism: All financial transactions for game sessions and crafts conducted via the Platform are securely processed through the third-party payment processor, Stripe. Players remit payment directly to DMs, and buyers remit payment directly to Crafters, with DnDUnited facilitating the connection to Stripe for these purposes. DnDUnited does not directly handle the transfer or storage of funds. 4.3. Revenue Distribution Model: For a promotional period of three (3) calendar months commencing from the official launch date of the Platform, DMs and Crafters shall be entitled to receive one hundred percent (100%) of the revenue generated from their services and products, respectively, exclusive of any processing fees levied by Stripe. Following the expiration of this initial promotional period, DnDUnited shall implement a commission fee of fifteen percent (15%) on each transaction. The remaining eighty-five percent (85%) of the transaction value, less Stripe’s processing fees, will be automatically transferred to the DM’s or Crafter’s designated bank account or other payment method supported by Stripe. These automated transfers are typically initiated approximately one (1) hour after the scheduled commencement of a game session or upon the confirmation of a craft purchase. 4.4. Game Session Cancellation and Refund Protocol: Game cancellations by the players are available up to 24 hours before the game starts. Only the DM can cancel the session and excuse a player in the last 24 before the game. If less than 24 hours remain before the game starts we recommend contacting your DM. Refunds will not be issued from DnDUnited under any circumstances. 4.5. Craft Return and Refund Policies: The policies governing returns and refunds for purchased crafts are established and managed solely by the individual Crafter. Buyers are advised to carefully review the Crafter’s stated return and refund policies prior to completing a purchase. DnDUnited may offer general guidance on return and refund processes, but the final determination regarding returns and refunds lies exclusively with the Crafter. Any monetary disputes arising from craft returns or refunds must be resolved directly between the buyer and the Crafter, potentially involving Stripe’s dispute resolution mechanisms, as DnDUnited assumes no direct liability for payment outcomes. 4.6. Handling of Payment Disputes and Chargebacks: DnDUnited exercises no direct control over the payment processing conducted by Stripe and shall not be held liable for the resolution of payment disputes or chargebacks initiated by Players or buyers. Users are solely responsible for understanding and adhering to Stripe’s policies and procedures for the resolution of such matters. While DnDUnited may provide general informational assistance, the ultimate resolution of monetary disputes rests with Stripe and the involved Users. 4.7. Tax Compliance Obligations: DMs and Crafters bear the exclusive responsibility for understanding and fully complying with all applicable local, national, and international tax laws and regulations concerning any income earned through their use of the Platform. DnDUnited explicitly disclaims any responsibility for the reporting, withholding, or payment of income taxes on behalf of DMs or Crafters. 5. Proprietary Rights 5.1. Platform Intellectual Property: All content displayed on or made available through the Platform, including, but not limited to, text, graphics, logos, software code, and design elements, is the exclusive property of DnDUnited or its licensors and is protected by applicable copyright, trademark, patent, and other intellectual property laws. Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for its intended purpose and in accordance with these Terms. No right, title, or interest in or to the Platform or any content therein is transferred to Users. 5.2. User-Generated Content License:By posting, uploading, or otherwise submitting any content to the Platform (including, but not limited to, game descriptions, craft listings, reviews, and communications), you hereby grant to DnDUnited a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media, in connection with the operation, promotion, and improvement of the Platform. User Feedback and Review System: Users may be permitted to post reviews and provide feedback regarding DMs, game sessions, Crafters, and crafts. All feedback and reviews must be truthful, fair, and constructive. DnDUnited reserves the right, but not the obligation, to monitor, edit, or remove any reviews or feedback that, in its sole judgment, violates these Terms or is otherwise deemed inappropriate. Users are encouraged to utilize the designated reporting mechanisms to flag any reviews they believe to be inaccurate, unfair, or in violation of these Terms. DnDUnited shall have the final authority in all matters of review moderation. 7. Disclaimer of Warranties and Limitation of Liability: 7.1. DnDUnited shall not be responsible for any loss or damage arising from or relating to the services or products offered by DMs or Crafters, or the conduct of any User. 7.3. Limitations on Liability: To the fullest extent permitted by applicable law, in no event shall DnDUnited, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses) arising out of or relating to your access to or use of, or inability to access or use, the Platform or these Terms, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, even if DnDUnited has been advised of the possibility of such damages.
